(hereinafter QUALERY), Spanish companydomiciled in Polígono Industrial Santa Ana, Parcela 61, 45526 Val de Santodomingo (Toledo, Spain), tax reference number NIF B45464567, distributor of coffee beans and soluble drinks (coffee, cocoa, tea, dairy products) and The Customer (hereinafter the Customer), with regard to any transaction carried out through the website www.qualery.com.
2.- Application of the General Conditions of Sale
Each order to QUALERY madeonline will be regulated by these General Conditions of Sale. Upon placing an order, the Customer acknowledges having read, understood and accepted without reservations these General Conditions of Sale, which - we would like to remind you – would be useful to be read in detail.
QUALERY reserves the right to modify theseGeneral Conditionsof Sale by publishing a revised version on this website. This will be applicable to all those orders made after QUALERY publishes the new version of the General Conditions of Sale on the website.
When making an order on this website, the Customer requests to purchase the product selected under these General Conditions of Sale.
4.- Order Confirmation
By accepting these General Conditions of Sale, online orders, after being confirmed by QUALERY, will constitute a binding and full contract between the parties.
QUALERY reserves the right to reject orders in the case of force majeure or failure to pay.
The information registered by QUALERY constitutes an absolute proof of the order and of the whole transaction.The information registered with the payment system constitutes an absolute proof of the financial transactions.
If the contracted product is not available, the Customer will be immediately informed and the paid amount will be reimbursed within fourteen (14) calendar days from the moment of that communication.
Following on the above, QUALERY might offer, at the same or lower price, a product of similar characteristics with the same or higher quality.In this case, the Customer will also be able to exercise their right to return the goods and of resolve in the same terms as if dealing with the goods originally requested.
The prices to be paid for the items requested by the Customerare those shown on this website at the momentof the order placement by the Customer. The prices will be detailed in the order confirmation and include VAT and/or any other applicable taxes, as well as shippingcosts and any other costs.
Shipping costs will be charged as indicated on the website when the Customer places their order, and will be calculated in relation to thesize, destination and delivery method of the order selected by the Customer. TheCustomer will be duly informed of those costs before making payment.
Once confirmedby QUALERY, all orders will be delivered to the delivery address indicated by the Customer when placing their order and within the time periodestablishedfor the service chosen by the Customer and which will be confirmed with their order.
Orders can only be delivered to the Spanish mainland.
If the order cannot be delivered for reasons beyond the control of QUALERY, a new attempt to contact the Customer will be made to arrange a new place and date for the delivery.If delivery cannot be made this time, the order will be returned to QUALERY storage facilities. From that time, the amount paid by the Customer, except from the shipment fees,will be reimbursed within (14) calendardays.
7.- Checking the goods
It is the Customer’s responsibility to check the quantity, condition and status of the goods at the time of delivery.
If the Customer notices that the goods are damaged or incomplete, they can contact QUALERY to inform them within one week after delivery of the goods. When QUALERY certifies that they are at fault for any shortcoming, QUALERY will replace the goods at no additional cost for the Customer.
The exercise of the right of returning food products will not be accepted in any case.
The customercan exercise their right to return any non-food product they do no longer require, within fourteen (14) calendardays from the order delivery.
To this effect, and for food safety reasons, QUALERY would like to remind you that they will only accept non-food products when they conserve their original, sealed packaging, providing they are accompanied by the corresponding proof of purchase.
QUALERY will collect the goods returned by the Customer and will be liable for the refund costs. The Customer must have the goods at the disposal of QUALERY for a maximum of five (5) calendardays after communicating the desire to return the goods.
Once QUALERY verifies that the Customerhas met the requirements to exercise their right to return the goods, QUALERY will refund the cost of the returned goods withina maximum of fourteen (14) days.
The Customer can pay for their order via PayPal and bank card (Secure payment).
Bank card payments will be charged after the Customer receives their order confirmation email.
The contract between QUALERY and the Customeris written in Spanish.
11.- Customer’s Responsibilities
The Customeris bound to carry out a licit use of the services and products provided by QUALERY, without contravening current legislation nor causing any damage to the rights and/or interests of third parties.
The Customer guarantees the truth and exactness of the data provided during purchase so as to avoid causing damages to QUALERY in the case of incorrect details.
The Customer commits to pay the price of the contracted products.
Non-compliance with any of these Conditions of Sale might cause the order to be rejected by QUALERY without the need towarn the Customer and withdrawing the right to any compensation.
12.- Applicable legislation and courts
These General Conditions of Sale are regulated by Spanish law.Any conflict or discrepancy with them will be submitted to the courts and tribunals as envisaged by the applicable legal norms in terms of the applicable jurisdiction, as dealing with end customers, the place of compliance of the obligation or the consumer’s domicile.
If the Customeris a company, both parties will be subject to, by renouncing expressly to any other court, the Courts and Tribunals of Toledo, Spain.
13.- Personal data
According to the EU regulation 2016/679 of 27 April 2016 (GDPR), current data protection laws and any applicable laws, QUALERY CULTURE, S.L.U. will processthe Customers’ personal data with the sole end of managing the Customer’spurchases and deliveries,for invoicing purposes and in order to comply with tax obligations.
The Customer will be able to exercise their rights of access, rectification, suppression, limitation of treatment, data portability and opposition, as well as the withdrawal of consent via email email@example.com.
